Benchling.ai Feature Specific Terms
These Benchling.ai Feature-Specific Terms (the “Feature-Specific Terms”) are incorporated by reference into, and supplement, the Benchling.ai Terms of Service (the “Terms”). They set out additional, feature-specific terms for certain Features of the Service.
The Feature-Specific Terms for a Feature apply if and when you use that Feature. You agree to the applicable Feature-Specific Terms as provided in Section 1.5 of the Terms — by clicking to agree or by accessing or using the applicable Feature. Benchling may add to, modify, or update these Feature-Specific Terms from time to time in accordance with the Terms.
Capitalized terms used but not defined here have the meanings given in the Terms. In the event of a conflict for the relevant Feature, the applicable Feature-Specific Terms control over the body of the Terms, as provided in Section 19.6 of the Terms.
A. Model Hub Feature-Specific Terms
A.1 Description. Model Hub lets you directly run and use Models (including Third-Party Models) against your Customer Data and retrieve the resulting Output.
A.2 Models and availability. The Models available through Model Hub are described in the Documentation and may change under Section 3.4 of the Terms. Third-Party Models are additionally subject to Section 7 of the Terms and Section A.3 below.
A.3 Third-Party Model Terms. Model Hub makes available Third-Party Models. Any additional terms applicable to a Third-Party Model — which may include the provider’s terms, an open-source or model license, and/or Benchling’s own model-specific terms — are set out on the Benchling Third-Party Model Terms page at https://www.benchling.com/third-party-model-terms (the same terms page referenced in Section 7.2 of the Terms), which Benchling may update from time to time. By activating, requesting access to, or running a Third-Party Model, you agree to any such additional terms applicable to that Model as provided in Section 1.5 of the Terms, and Benchling may also require you to affirmatively accept those terms before you run the Model. Those terms bind you and may impose additional restrictions on use, inputs, Output, and data. Third-party models embedded to power a Feature that you do not directly run are not Third-Party Models (see Section 2.16 of the Terms) and are provided as part of the Service.
A.4 Output; validation. Output from Model Hub is provided on an “as-is” basis and is subject to Sections 6 and 8.3 of the Terms, including the intended-use, validation, and prohibited-use provisions. You are responsible for independently validating Output before relying on it.
A.5 Metering. Model runs consume Units as described in the Documentation and, if and when Benchling charges, the Payment Terms.
